President Susan Warnstrom called the meeting to order at 7:10 p.m. The attendees were introduced. All present participated in the Pledge of Allegiance to the flag of the United States.
Treasurer’s Report: Chuck Arnold reported the checking account has $1,216.88 and the savings account $1,381.92 for a total of $2,598.80.
Approval of Minutes: Motion, second, unanimous, to approve the Minutes of the June 27, 2005 meeting.
Legislative Report: George Emerson reported both the Salinas bill and SB135 on community service district law will be before the full State Senate in August.
Guest Speaker: David Patzer, CSRMA Risk Control Advisor: Mr. Patzer addressed regulatory issues of Cal-OSHA that have been developing for several years. He distributed a summary matrix of 65 regulations from Cal-OSHA, CalEPA, and local regulatory items. He said 33 of the items require a written plan, policy, or procedure. All 65 items require training. Mr. Patzer cautioned against adopting a generic plan. It is necessary to have a site specific plan and training, and once adopted they all should be reviewed and updated every 2 years. Non-compliance can result in fines, lawsuits, and damaged public credibility.
Mr. Patzer said AB 1127, passed in 2000, subjects public agencies to fines and penalties and civil and criminal penalties and even prison. Serious violations can cost up to $18,000 to $25,000 per day. Agencies need documentation showing that they do what their Illness and Injury Prevention Plan says they do. Mr. Patzer briefly reviewed the concepts of independent employee action defense, a multi-employer worksite, exposing employer defense, vicarious liability, and a programmatic approach to reduce exposure. He emphasized pre-qualification of contractors for a site safety program and transfer of risk. Mr. Patzer suggested you ask your liability insurer to inspect your agency for OSHA regulatory compliance. Your policies and documentation coupled with documented employee training can reduce your liability exposure.
Consideration of Chapter By-law change: The Chapter’s executive committee recommends changing Article 3, Section 1, to authorize increasing the chapter directors from twelve to fourteen, with the at large directors being increased from two to four.
Motion, second, to strike the phrase "without election" from the proposal. Unanimous.
Motion second, to approve the change in the Chapter by-laws. Unanimous.
Selection of Additional Directors: George Emerson and Craig Murray were nominated to the new positions of at large directors. Unanimous to close the nominations. Unanimous to elect George Emerson and Craig Murray to the positions of at-large director.
LAFCo Report: Tim Campbell and Cathy Schlottmann noted the draft Municipal Service Reviews have been sent to the agencies in the South County. The agencies have until August 19th to submit their comments, and then the MSRs will become public with public hearings held September 1st or later. During discussion with the agencies involved, it was consensus that the proposed "joint sphere of influence" for Goleta Sanitary District and Goleta West Sanitary District is presumptuous at this point in time. Any agency with questions on their draft MSR should contact Bob Braitman at LAFCo.

Adjournment President Warnstrom adjourned the meeting at 8:50 p.m. The next meeting will be Monday, August 22, 2005 at this location.
